Terms of use
These are the plain-English terms for using Heapso. Please give them a read: they're shorter than a staff meeting.
Draft: to be reviewed by a lawyer before launch
The agreement
These terms are an agreement between you and Heapso. By creating an account or using Heapso you agree to them, to our privacy statement, and to the acceptable use rules below. If you use Heapso through a school, your school's agreement with us (including the data processing agreement) also applies.
Teachers only
Heapso is for teachers, teacher aides, school leaders, relievers, initial teacher education students and other education professionals aged 18 or over. It isn't designed for students, and students must not be given access to an account. You're responsible for keeping your sign-in secure and for activity on your account.
Acceptable use
You agree not to:
- enter information that identifies a student, names, National Student Numbers, dates of birth, contact details or health and learning-support details about a named student (use initials or "Student A");
- upload content you don't have the right to use, or ask Heapso to reproduce copyrighted material in full;
- create content that is unlawful, harassing, discriminatory, sexually explicit, or that harms children;
- use Heapso to deceive people, including passing off AI-generated work as student work or official assessment material;
- share your account, resell access, or use automated tools to scrape or bulk-generate content;
- try to break, overload or get around the security, credit or fair-use limits of the service;
- use Heapso's output to build a competing AI model or service.
We may suspend accounts that break these rules. Where we can, we'll tell you first and give you a chance to fix things.
Your content and AI output
You own what you put in and what Heapso creates for you, as far as the law allows. You give us permission to store and process it to run the service for you. We don't use it to train AI models.
AI can be wrong. Treat everything Heapso produces as a draft: check facts, curriculum alignment, safety notes and cultural content before using it with ākonga. Curriculum and NCEA references link to the official sources at Tāhūrangi and NZQA, which are the authority. Assessment decisions remain the teacher's and the school's.
Plans and payment
- Pro is NZ$7 a month or NZ$69 a year, including GST.
- School seats are billed yearly, plus GST: NZ$65 per seat for 5–19 seats, NZ$55 for 20–49 and NZ$49 for 50 or more. Every seat is charged at the rate for the total number of seats. Whole-school licences are quoted separately.
- Subscriptions renew automatically at the end of each period until cancelled.
- Schools pay by card through our payment provider, Stripe. A school can download a PDF quote to raise a purchase order first; a quote doesn't give access, which starts once the card payment goes through. Your PO number is printed on the GST receipt.
- We'll give at least 30 days' notice of any price change, which applies from your next renewal.
credits and top-ups
Planning (lessons, units, worksheets, chat and prompt tools) doesn't use credits. Some heavier items, such as slide decks, images, uploads and timetable extraction, use credits.
- Your plan includes a monthly credit allowance. Unused monthly credits don't roll over.
- Teachers get 10 one-off bonus credits when they verify a school email. Each school email address can unlock them once, and they expire 14 days after they're added.
- Top-up credits you buy expire 12 months after purchase. They're used after your monthly allowance runs out.
- Credits have no cash value, can't be transferred, and are not refundable except where the law requires.
- If a generation fails, any credits held for it are released automatically.
Fair use
"Unlimited" planning means unlimited for a teacher's genuine planning work. If an account's usage is far beyond what a busy teacher would need, for example automated or shared use, we may slow down or limit generation. We'll contact you before taking any lasting action.
Cancellation and refunds
- You can cancel at any time in Plan & billing. You keep access until the end of the period you've paid for.
- We don't give partial refunds for unused time, except where the law requires or we've made a mistake.
- School seats can be added at any time (charged pro rata) and reduced at renewal.
- If a renewal payment fails and isn't fixed after our reminders, the account may move to read-only until the card is updated.
- After cancellation you can still export your content for 90 days before it's deleted (see our privacy statement).
School accounts
When a school buys seats, the school is our customer and controls school data. School admins can manage seats, view usage and shared content, and set data controls. They can't see teachers' private drafts. If you leave the school, your seat can be reassigned. [What happens to your private content when you leave a school: to confirm before launch.]
Availability and changes
We work hard to keep Heapso running but can't promise it will always be available or error-free. We may change features over time. If we make a change that significantly reduces what you've paid for, you can cancel and we'll refund the unused part of your current period. We'll give notice of material changes to these terms by email.
Liability
Nothing in these terms limits rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that can't be excluded. Otherwise, to the extent the law allows, we're not liable for indirect or consequential loss, and our total liability to you is limited to the amount you paid us in the 12 months before the claim.
New Zealand law
- These terms are governed by New Zealand law, and New Zealand courts have jurisdiction.
- Personal (Pro) accounts: if you use Heapso as a consumer, you have the protections of the Consumer Guarantees Act 1993.
- Schools and other organisations: you're acquiring Heapso for the purposes of a business (in trade). To the extent permitted by section 43 of the Consumer Guarantees Act 1993 and sections 5C and 5D of the Fair Trading Act 1986, those Acts don't apply, and the parties agree it is fair and reasonable to contract out of them.
